These terms and conditions outline the rules and regulations for the use of Ausplan.

By accessing our website or platform, you agree to comply with these terms and conditions. If you do not agree with any part of these terms, please refrain from using Ausplan’s website or services.

Definitions

• Client, You, and Your refer to the user accessing this website and accepting Ausplan’s terms and conditions.
• Company, We, Our, and Us refer to Ausplan.
• Party, Parties, or Us refer to both the Client and the Company.

Compliance with Australian Financial Regulations

Ausplan is built to assist financial advisors in meeting Australian regulatory requirements, including:

• Corporations Act 2001 (Cth), covering financial advice obligations.
• Guidelines provided by ASIC (Australian Securities and Investments Commission).
• Privacy compliance under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

While Ausplan provides tools to support compliance, the ultimate responsibility for meeting legal obligations lies with the user.

Data Ownership and Access

All data entered into Ausplan remains the property of the user or their business. Ausplan provides tools to export or delete data upon request. Users can also access and review their data at any time through the platform.

Confidentiality and Data Sharing

Ausplan guarantees the confidentiality of all data stored on the platform. We do not share, sell, or disclose client information to third parties without explicit consent, except where required by law.

Data Security and Storage

Ausplan uses end-to-end encryption and encryption of data at rest to protect all user and client information. Data is securely stored in Australian data centers, ensuring compliance with Australian data sovereignty laws.

Subscription and License Terms

Ausplan operates on a subscription basis. Users agree to:

• Pay subscription fees according to the plan selected.
• Automatic renewal of subscriptions unless canceled prior to the renewal date.
• Compliance with the terms of any trial or introductory periods.

Support and Service Level Agreement (SLA)

Ausplan offers the following support services:

• Standard support hours are 9:00 AM to 5:00 PM AEDT on business days.
• Response times for support requests typically within 24 hours.
• Targeted uptime of 99.5%, with scheduled maintenance occurring outside standard business hours where possible.

Termination and Data Retention

Upon termination of your subscription:

• Users can request an export of their data before the account is closed.
• Data is retained for 90 days after termination, after which it will be permanently deleted unless required by law.

Professional Indemnity and Liability

Ausplan provides tools and resources to assist financial advisors in managing compliance and generating Statements of Advice (SOAs). However, the platform does not guarantee full compliance with Australian regulations. Users are responsible for ensuring the accuracy and suitability of all financial advice provided.

Audit and Reporting Features

Ausplan includes tools to assist with compliance reporting and audits. However, these tools are supplementary, and users are ultimately responsible for meeting their regulatory obligations under Australian law.

Content and Intellectual Property

Unless otherwise stated, Ausplan and/or its licensors own the intellectual property rights for all material on the platform. Users may access content for personal and professional use, subject to the following restrictions:

• You must not republish, sell, or redistribute material from Ausplan without prior consent.

Limitation of Liability

Ausplan provides its platform "as is" and makes no guarantees regarding uninterrupted access or error-free performance. To the fullest extent permitted by law, Ausplan is not liable for any losses or damages arising from the use of the platform.

Modifications

Ausplan reserves the right to update these terms and conditions at any time. Continued use of the platform constitutes acceptance of any changes.
